A medical power of attorney names someone, your health care agent, to make treatment decisions when you cannot. This draft builder writes the document from your choices: name Maria as agent and David as alternate with four powers that start on incapacity, and you get six numbered sections plus signature, witness, notary and agent acceptance lines.

About this tool

Adults arranging advance care plans, and the relatives helping them, often need a health care proxy document before a hospital stay or surgery. This builder turns a few choices into a plain-language medical power of attorney: who the agent is, a backup agent, which powers they hold (consent to treatment, life support, choice of providers, medical records, after-death decisions), when the authority begins and any limits you write yourself. The panel beside the draft lists each choice, counts the sections and words, and flags gaps such as a missing alternate. One limit matters: many US states publish a statutory form with set wording and require two witnesses or a notary, and some bar certain people, such as your own doctor, from serving as agent. Treat the result as a draft to compare against your state's form, not a filed legal instrument.

How to use it

  1. Enter your name and state

Your legal name opens the document; the state is used in the notary line and to warn you when it is left out.

  2. Name the agent and an alternate

Add the agent's name and phone, and a second person who steps in if the first cannot act.

  3. Choose the powers

Tap the chips for each power you grant. At least one is needed.

  4. Set the start and any limits

Pick on incapacity or on signing, then type any restrictions; the draft updates as you go.

Takes effect: On signing
Words: 158

  2. Appointed Ana Rivera with no alternate.
  3. Listed 2 powers and the start condition, plus your limits.
  4. Closed with signature, two witness lines, a notary line and the agent’s acceptance.

One agent, effective on signing, with a written limit on experimental care. The draft flags the missing alternate and state.

How it is calculated

Draft = declaration + agent + alternate (if named) + powers + start condition + limits (if any) + guidance + copies + signature block

agent
The person who makes health decisions for you when the document is in effect
alternate
A backup agent who acts if the first is unwilling or unavailable
start condition
Either a physician's written finding of incapacity or the moment of signing

The sections follow the elements the National Institute on Aging and MedlinePlus describe for a durable power of attorney for health care. Each optional section is numbered only when you fill it, so the count in the panel matches the text. The guidance clause tells the agent to follow your known wishes, including a living will, and otherwise your best interest, which is the substituted-judgment standard most state statutes use.

Sources

When not to use it

  • Your state requires its own statutory proxy form word for word.
  • You need someone to handle money or property, which takes a financial power of attorney.
  • A family dispute over your care is already likely to reach court.

Common mistakes

  • Naming an agent without first asking whether they are willing to serve.
  • Leaving out an alternate, so no one can act if the agent is unreachable.
  • Signing without the witnesses or notary your state requires.
  • Keeping the only copy in a safe deposit box the agent cannot open.

Frequently asked questions

How is a medical power of attorney different from a living will?

A living will records your own treatment choices, such as refusing a ventilator. A medical power of attorney names a person to decide for you, including in situations the living will does not cover. Many people sign both, and the guidance clause in this draft tells the agent to follow any living will you have.

Who can serve as my health care agent?

Usually any competent adult you trust, such as a spouse, adult child or friend. Many states bar your treating doctor, staff of your care facility, or a witness to the document from serving. Check your state's statute or form for its exact list before choosing.

Does it need a notary?

It depends on the state. Some require two adult witnesses, some a notary, and some accept either. Witnesses often cannot be your agent or a relative. The draft includes both witness lines and a notary line so you can complete whichever your state asks for.

What does 'on incapacity' mean in practice?

The agent's authority starts only once your attending physician finds, in writing, that you cannot make or communicate your own health decisions. Until then you decide for yourself. Choosing 'on signing' instead lets the agent talk to doctors right away, while your own instructions still take priority when you can give them.

Can I revoke or change it later?

Yes. While you have capacity you can revoke it, usually by telling your doctor or agent, or by signing a new document. Destroy old copies and give the new one to your agent, alternate and doctors so no one relies on an outdated version.

Will a hospital in another state accept it?

Many states honour a health care proxy that was valid where it was signed, but recognition is not uniform. Someone who lives part of the year in another state may sign that state's form as well.

Why include medical records access?

Without it, privacy rules can stop providers from sharing your chart with the agent, which slows decisions. Naming the agent as your personal representative under HIPAA lets them see test results and notes they need to decide well.
