Enter your name, where you live, an executor and each beneficiary with a percentage share. The generator writes a short will with a revocation clause, executor appointment, residue split and a signature block for two witnesses. For example, two children at 50 each produce a 100% residue split in clause 3. Shares that do not total 100 are rejected.

About this tool

A simple will covers the common case: one person, a handful of beneficiaries, and the whole estate divided by percentage after debts. This generator turns those facts into a plain-English draft you can read through, edit and take to a solicitor or attorney for checking. It adds an alternate executor if you name one, a guardian clause when you have children under 18, and a survivorship line so a share passes to the others if a beneficiary dies first. The signature block is laid out for two witnesses, matching England and Wales and most US states. It cannot handle trusts, property abroad, business interests or specific gifts of named items, and a draft only becomes a valid will once it is signed and witnessed under your local law. Nothing you type is sent anywhere.

How to use it

  1. Fill in your details

Type your full legal name, where you live and the executor, plus an alternate executor if you have one.

  2. List beneficiaries

Write one person per line followed by their percentage share; the shares must add to 100.

  3. Answer the children question

Choose Yes under children under 18 to show the guardian field and add a guardian clause.

  4. Copy the draft

Copy the generated text into a document, review every clause and have it signed in front of two witnesses.

I, Amina Rahman, of Leeds, England, declare this to be my last will. I revoke all earlier wills and codicils made by me.

1. Executor. I appoint Omar Rahman as executor of this will.

2. Debts and expenses. My executor shall pay my debts, funeral expenses and the costs of administering my estate.

3. Residuary estate. I give the rest of my estate, after the payments in clause 2, to the following people in these shares:
(a) Omar Rahman: 50%
(b) Laila Rahman: 50%
If any of them dies before me, their share shall be divided among the others in proportion to their shares.

Signed by Amina Rahman on ____________ (date), in our presence, and then by us in the testator's presence.

Witness 2 name, address and signature: ______________________
Beneficiaries: 2
Shares allocated: 100%
Witnesses needed: 2

  1. Read 2 beneficiary line(s); shares total 100%.
  2. Built clauses: revocation, executor, debts, residue, signature block.
  3. Signature block set for two witnesses present at the same time, as Wills Act 1837 s.9 requires.

Each child receives half of the residue; because the executor is also a beneficiary, the draft reminds you that beneficiaries cannot witness.

  1. Read 3 beneficiary line(s); shares total 100%.
  2. Built clauses: revocation, executor with alternate, debts, residue, guardian, signature block.
  3. Signature block set for two witnesses present at the same time, as Wills Act 1837 s.9 requires.

Sixty, twenty-five and fifteen percent add to 100, and the guardian clause appears because Yes is chosen for children under 18.

How it is calculated

residue share of each beneficiary = stated % × (estate − debts − funeral and administration costs); shares must sum to 100%

stated %
the percentage you type after each beneficiary's name
residue
what is left of the estate after clause 2 payments
2 witnesses
the number of people who must watch you sign under Wills Act 1837 s.9

Each line is read as a name followed by a number, so 'Omar Rahman 50' and 'Omar Rahman, 50%' both work. The shares are summed and the draft is only produced when they total exactly 100. Clauses are assembled in a fixed order: revocation of earlier wills, executor, payment of debts, residue split with survivorship, an optional guardian clause and the attestation block.

Sources

When not to use it

  • An estate with trusts, foreign property or a business needs a lawyer-drafted will.
  • Scotland and some civil-law countries apply different signing rules than the two-witness block here.
  • Gifts of specific items or fixed cash sums are not supported by this template.

Common mistakes

  • Letting a beneficiary or their spouse act as a witness, which can void their gift in England and Wales.
  • Entering shares that add to 90 or 110 instead of exactly 100.
  • Printing the draft but never signing it in front of two witnesses present together.

Frequently asked questions

Is a generated draft legally valid on its own?

No. Text on a screen is not a will. Under section 9 of the Wills Act 1837, and similar laws in most US states, it must be in writing, signed by you and witnessed by two people present at the same time.

Who can be a witness?

Any adult with capacity who is not a beneficiary and not married to one. In England and Wales a beneficiary who witnesses keeps the will valid but loses their gift.

What happens if a beneficiary dies before me?

The draft includes a survivorship line: that person's share is split among the remaining beneficiaries in proportion to their shares. With 50, 30 and 20, losing the 20 leaves 62.5 and 37.5.

Can the executor also inherit?

Yes, naming a spouse or child as both executor and beneficiary is common. The draft shows a reminder because that person must not also witness the signing.

Why must the shares total exactly 100?

Any shortfall would leave part of the residue undisposed of, which then passes under intestacy rules rather than your wishes. Shares over 100 cannot be paid at all.

Does the guardian clause bind a court?

A named guardian is a strong statement of your wishes, and courts usually follow it, but in the US a judge still confirms the appointment in the child's interest.
